Terms of Service

Welcome to MotherTree! These Terms of Service ("Terms") govern your access to and use of the MotherTree platform, websites, services, and applications (collectively, the "Service"), operated by MotherTree ("Company," "we," "us," or "our").

By creating an account, accessing, or using MotherTree, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

1. Early Access And Preview Phase Notice

  • Preview Version: MotherTree is currently in an "Early Access" / "Preview" phase. The Service is made available to you on an "AS IS" and "AS AVAILABLE" basis for preview, evaluation, and feedback purposes.

  • Feature Availability & Changes: Certain features (including but not limited to pet management, recipe vaults, document storage, and family sharing) may be incomplete, subject to bugs, or undergoing active modification. We reserve the right to modify, suspend, add, or discontinue any feature, tool, or aspect of the Service at any time without prior notice.

  • User Feedback: By submitting suggestions, feature requests, or feedback regarding the Service, you grant MotherTree a non-exclusive, royalty-free, perpetual, worldwide license to use and incorporate your feedback into the platform without restriction or compensation.

2. Eligibility & Account Registration

  • Age Requirements: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account and use the Service.

  • Account Accuracy: You agree to provide accurate, current, and complete information during registration and to update your details as necessary.

  • Account Security: You are responsible for safeguarding your login credentials (including third-party authenticators such as Google or Clerk) and for all activities that occur under your account. Notify us immediately of any unauthorized access

3. Subscription Tiers & Billing

MotherTree offers both free and paid subscription tiers during the Early Access phase

  • Free Tier: Access to basic features and limited storage options is available free of charge. We reserve the right to modify free tier limits or features as the platform evolves.

  • Paid Tier (Early Access Pricing): Paid subscriptions unlock expanded features, higher storage capacity, and specialized vaults (e.g., family documents, recipes, pet records).

  • Payment Terms: Billing occurs on a recurring subscription basis (monthly or annually). Payments are processed securely via third-party payment processors. You authorize us to charge your payment method for all applicable fees upon confirmation.

  • Paid Early Access Acknowledgement: Paying for a premium tier grants access to advanced features as they currently exist. Payment does not guarantee that the Service or any specific feature will remain error-free, uninterrupted, or unchanged during the preview period.

  • Refund Policy: Except where required by applicable law or explicitly stated otherwise by MotherTree, subscription fees are non-refundable.

4. User Content & Intellectual Property

  • Ownership of Your Content: You retain full ownership of all text, documents, recipes, media, pet records, and other materials you upload, post, or store on MotherTree ("User Content").

  • License to MotherTree: You grant MotherTree a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, transmit, and display your User Content solely as necessary to provide, maintain, and secure the Service for you

  • MotherTree Intellectual Property: The platform name, logo, branding, design, software code, user interface, and proprietary tools are the exclusive property of MotherTree and its licensors. You may not copy, reverse engineer, or redistribute any part of our platform without prior written consent.

5. Data Privacy & Backups

  • Privacy Policy: Your privacy is paramount. Please review our [Privacy Policy] to understand how we collect, use, and protect your personal information and uploaded files.

  • Data Backups During Early Access: While MotherTree employs industry-standard security and backup protocols, you acknowledge that software in an early access phase carries inherent risks of technical glitches. You are strongly encouraged to maintain independent backups of all critical personal documents uploaded to the platform

6. Prohibited Activities

You agree not to engage in any of the following activities:

  • Uploading illegal, fraudulent, harassing, defamatory, or harmful content.

  • Uploading malicious code, viruses, or attempting to compromise platform security or infrastructure.

  • Attempting to gain unauthorized access to other users' family vaults or data

  • Using automated systems (bots, scrapers) to extract data from the Service without permission.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. MOTHERTREE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MOTHERTREE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED IMMEDIATELY

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOTHERTREE, ITS FOUNDERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MOTHERTREE’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE TOTAL AMOUNT PAID BY YOU TO MOTHERTREE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

  • By You: You may stop using the Service or delete your account at any time through account settings or by contacting support.

  • By MotherTree: We reserve the right to suspend or terminate your account or access to the Service at our sole discretion, with or without notice, if we believe you have violated these Terms or if necessary for security or operational reasons

10. Modifications to Terms

We may update these Terms from time to time to reflect platform improvements, legal updates, or changes to our business. When material changes are made, we will notify you by updating the "Last Updated" date at the top of this page, sending an email notification, or displaying a banner within the platform. Your continued use of MotherTree after changes take effect constitutes your acceptance of the revised Terms.​

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state/jurisdiction in which MotherTree is registered, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the applicable courts of that jurisdiction.
