Privacy Policy
MotherTree Corporation ("MotherTree," "we," "us," or "our") respects your privacy and is committed to protecting the personal information and cherished family archives you entrust to us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (www.mothertree.cloud) and use our web application (app.mothertree.cloud) (collectively, the "Service").
Please read this Privacy Policy carefully. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by all the terms of this Privacy Policy.
1. Information We Collect
We collect information that identifies, relates to, describes, or could reasonably be linked with you or your family members ("Personal Information").
A. Information You Provide Directly
-
Account & Login Information: When you register for an account or start a 14-day free trial, we collect your name, email address, password, and account preferences. User authentication, login credentials, and session security are managed securely via our specialized identity infrastructure partner, Clerk.
-
Family Archive Content (User Content): Photos, audio recordings, video files, text notes, document uploads, family tree node names, relationships, birth/death dates, and oral histories that you upload or record directly into the platform.
-
Payment Data: Payment transactions are processed directly by our third-party payment processor, Stripe. MotherTree Corporation does not store or process complete credit card numbers or billing credentials on our servers. Stripe collects and processes payment information in accordance with their own Privacy Policy.
-
Communications: When you contact customer support, request help, or send feedback, we collect your email address (cee@mothertree.cloud) and any messages you send.
B. Information Collected Automatically
-
Usage & Technical Log Data: When you access the Service via Amazon Web Services (AWS) infrastructure, we automatically log basic technical information required for platform security and performance, including your Internet Protocol (IP) address, browser type, operating system, and session timestamps.
-
Essential Session Cookies: We use strictly necessary cookies and security tokens (managed through Clerk and AWS) to maintain your logged-in session, verify your identity, and keep your family tree session secure.
2. Our Core Commitment: Your Data Belongs to You
We do not sell, rent, monetize, index, or trade your family media, photos, voice recordings, or personal data to third parties, advertising networks, or data brokers.
Your family archives are treated as private, secure digital assets. Specifically:
-
No Ad Mining: Your uploaded media and family tree data will never be mined or analyzed for targeted advertising, profiling, or marketing campaigns.
-
No Search Engine Indexing: Private family trees, audio clips, and uploaded media are kept strictly unindexed by public search engines (e.g., Google, Bing).
-
AI & Machine Learning Protection: Your private media and voice recordings are never used to train public generative AI or machine learning models.
3. How We Use Your Information
We use the information we collect solely to provide, maintain, and improve the Service, including to:
-
Create and manage your account and family tree archives.
-
Authenticate your identity and protect your account against unauthorized access via Clerk.
-
Process subscription billing, 14-day free trials, and lifetime buyout options via Stripe.
-
Allow you to invite and share private access with explicit family members or collaborators you choose.
-
Store, transcode, backup, and stream your audio, video, and image files securely on AWS servers.
-
Send essential transactional emails (e.g., password resets, billing receipts, account alerts).
-
Ensure system reliability, network security, and data integrity.
4. How Your Information Is Shared
We only share your information in the following limited circumstances:
-
With Your Invited Collaborators: Content you post to a family tree is accessible only to relatives or collaborators you explicitly invite to your private tree.
-
Trusted Service Infrastructure: We work with industry-standard third-party providers strictly to operate our platform—specifically Amazon Web Services (AWS) for secure cloud storage and hosting, Clerk for identity management and authentication, and Stripe for payment processing. These vendors process data only as necessary to perform specific infrastructure tasks on our behalf under strict confidentiality obligations.
-
Legal Requirements: We may disclose information if required to do so by law or in the good faith belief that such action is necessary to comply with legal obligations, protect against legal liability, or safeguard the physical safety of any person.
-
Business Transfers: If MotherTree Corporation is involved in a merger, acquisition, asset sale, or corporate reorganization, your account data may be transferred as part of that transaction, provided the acquiring entity honors the exact privacy commitments outlined in this policy.
5. Data Security & Hosting Infrastructure
Your data is hosted and maintained using Amazon Web Services (AWS) enterprise-grade cloud infrastructure alongside Clerk’s encrypted authentication services. We implement administrative, physical, and technical security protocols (including SSL/TLS encryption in transit and standard encryption at rest) designed to protect your Personal Information and uploaded family media against unauthorized access, loss, or alteration.
6. Data Retention & Account Deletion
-
Data Ownership: You retain 100% full ownership of all family media, photos, audio clips, and tree data uploaded to MotherTree.
-
Account Cancellation & Deletion: You may cancel your subscription or request complete account deletion at any time by contacting us at cee@mothertree.cloud. Upon account deletion, we will permanently purge your account data, login profile, and uploaded media from our active systems on AWS and Clerk.
7. Children's Privacy
The Service is intended for adult account holders (parents, grandparents, and family historians). While family trees may contain photos or names of children added by parents or legal guardians, MotherTree Corporation does not knowingly collect Personal Information directly from children under the age of 13. If you believe a child under 13 has created an account directly without authorization, please contact us immediately.
8. Governing Law & State Rights (New Jersey & US Privacy)
